Special Leave Petitions (SLPs)

Why in News?

The rising number of Special Leave Petitions (SLPs) has raised concerns about the increasing caseload of the Supreme Court. It has also triggered debate over whether merely increasing the strength of the judiciary can effectively address judicial pendency.

What is a Special Leave Petition (SLP)?

1. Constitutional Provision – Article 136

  • Article 136 of the Constitution empowers the Supreme Court of India to grant special leave to appeal against judgments, decrees, determinations, sentences or orders passed by Any court in India and Any tribunal constituted in India.

2. Discretionary Jurisdiction

  • An SLP is not an automatic or statutory right of appeal.
  • The Supreme Court has the discretion to either grant or refuse special leave.
  • Therefore, filing an SLP does not guarantee that the matter will be admitted for appeal.

3. Wide Scope

  • Article 136 extends to civil, criminal and other judicial matters.
  • Its broad scope enables the Supreme Court to examine decisions across different areas of law, subject to constitutional limitations.

4. Exceptional Constitutional Remedy

  • The Supreme Court has consistently held that Article 136 confers an extraordinary jurisdiction.
  • It is intended to address serious instances of injustice or substantial errors of law.
  • It is not meant to operate as a routine appellate mechanism against every decision of a lower court or tribunal.

5. Constitutional Exception

  • Article 136 does not apply to judgments or orders passed by courts or tribunals constituted under laws relating to the Armed Forces.

Why Are SLPs Contributing to Judicial Pendency?

1. Increasing Number of Filings

  • The wide scope of Article 136 allows litigants to approach the Supreme Court against a broad range of judicial decisions.
  • This contributes significantly to the Court's overall caseload.

2. Judicial Time Required at the Admission Stage

  • Although the Supreme Court can reject an SLP, each petition must still undergo scrutiny at the admission stage.
  • This consumes judicial time and administrative resources, even when special leave is ultimately refused.

3. Routine Litigation

  • Litigants frequently attempt to challenge decisions of lower courts through SLPs.
  • Such routine litigation may divert the Supreme Court's attention from Important constitutional questions, Substantial questions of law and Matters of national legal significance.
