Tribunals Reforms Bill, 2026
Why in News?
The Lok Sabha passed the Tribunals Reforms Bill, 2026, seeking to replace the Tribunals Reforms Act, 2021 and introduce greater uniformity, transparency and institutional oversight in the functioning and appointment of tribunal members.
The Bill follows Supreme Court interventions concerning provisions of the 2021 framework and seeks to strengthen the institutional architecture governing tribunals.
Key Provisions
1. National Tribunals Commission (NTC)
- The Bill proposes a National Tribunals Commission as an apex administrative body responsible for Tribunal appointments, Performance reviews, Disciplinary inquiries, Administrative oversight of tribunals.
- Headquarters: New Delhi
- Composition – 5 Members
- Chairperson: Former Supreme Court Judge or former Chief Justice of a High Court.
- 2 Judicial Members: Former Chief Justices or Judges of High Courts, appointed in consultation with the Chief Justice of India.
- 2 Technical Members: Experts with at least 25 years of experience in public administration, finance, law, accountancy or technology.
- Tenure: 5 years or until attaining 70 years, whichever is earlier.
2. Search-cum-Selection Committees
- The NTC will constitute committees for appointments to tribunals.
- The proposed committee includes NTC Chairperson/Judicial Member, Retired Chief Justice/Judge of a High Court, Technical Member of NTC, Government Secretary, Two expert members, Commission Secretary.
Important Features
- Expert members and Commission Secretary: No voting rights.
- Chairperson: Has a casting vote in case of a tie.
- Recommendation: One primary candidate and one waiting-list candidate for each vacancy.
- This replaces the earlier dual-candidate panel system.
- Appointment deadline: Central Government must issue appointment orders within three months of receiving recommendations.
3. Uniform Service Conditions
- Tenure: 5 years.
- Chairperson's age limit: 70 years.
- Member's age limit: 67 years.
- Re-appointment: Chairpersons and members may be considered for re-appointment.
Grounds for Removal
- A Chairperson or Member may be removed on grounds including Insolvency, Conviction for offence involving moral turpitude, Physical or mental incapacity, Abuse of position, Financial or other interests prejudicial to official functions.
For tribunal members, additional grounds include:
- Incompetence or inefficiency.
- Taking up a paid assignment.
Removal for misbehaviour or incapacity requires a formal inquiry headed by a Supreme Court Judge.
4. National Tribunals Data Grid (NTDG)
- The Bill proposes a centralised National Tribunals Data Grid.
- Purpose; Serve as a repository of case-related data, Track case pendency and disposal, Improve transparency, Facilitate monitoring of tribunal performance., Enable better data-driven administration.
- It would cover specified quasi-judicial bodies, including tribunals such as the National Green Tribunal (NGT) and CESTAT.
Significance
- Greater Institutional Uniformity: Common rules for appointments, tenure, age limits and service conditions can reduce inconsistencies across different tribunals.
- Addressing Vacancies: The mandatory three-month appointment timeline seeks to prevent prolonged vacancies that contribute to tribunal pendency.
- Judicial Independence: The greater involvement of serving and retired members of the higher judiciary in the selection architecture seeks to strengthen safeguards for judicial independence and separation of powers.
- Transparency and Data-Based Governance: The NTDG can provide a centralised picture of tribunal pendency and performance, facilitating evidence-based reforms.
- Administrative Efficiency: The NTC would create a dedicated institutional mechanism for tribunal administration rather than leaving appointment and administrative matters fragmented across different departments.
Merchant Discount Rate (MDR)
Why in News?
The government clarified that Unified Payments Interface (UPI) transactions will continue to remain free for consumers, while a limited Merchant Discount Rate (MDR) may be introduced for certain high-value transactions.
What is Merchant Discount Rate (MDR)?
1. Definition
- MDR is the fee charged to merchants for processing digital payments.
2. Purpose
- It compensates banks, payment service providers and payment networks for the infrastructure and operational costs involved in digital transactions.
3. Revenue Distribution
MDR is generally shared among:
- Issuing Bank: Bank of the customer.
- Acquiring Bank: Bank that provides payment services to the merchant.
- Payment Network: Entities such as NPCI, Visa or Mastercard.
India’s Zero-MDR Regime
- Since 2020, the government has mandated zero MDR on UPI and RuPay debit-card transactions to accelerate digital payments.
- The provision was introduced through Section 10A of the Payment and Settlement Systems Act, 2007.
- The proposed amendment removes the automatic blanket restriction on levying charges on notified electronic payment modes.
Why is MDR Being Considered?
