Article 240 & Chandigarh – Issue Explained

The Home Ministry clarified that no Bill will be introduced in the upcoming Winter Session to change the status of Chandigarh, after a Lok Sabha bulletin mistakenly suggested a Constitution Amendment to include Chandigarh under Article 240.

If such an amendment were introduced, it would have allowed appointment of an independent Administrator, instead of the current arrangement where the Punjab Governor serves as the Administrator of Chandigarh.


What Was the Proposal?

  • The bulletin had indicated a move to bring Chandigarh under Article 240.
  • This would have enabled the President to frame regulations for Chandigarh directly.
  • It could also create scope for an independent Administrator, separate from the Punjab Governor.

However, the Centre clarified that no such amendment will be introduced.


Current Status of Chandigarh

  • A Union Territory serving as the joint capital of Punjab and Haryana.
  • Administrator: By convention and notification, the Governor of Punjab acts as the Administrator of Chandigarh under Article 239.

Understanding Article 240 of the Constitution

1. Article 240:

  • Power of President to Make Regulations for Certain Union Territories

2. The President may make regulations for the peace, progress and good governance of the following UTs:

  • Andaman & Nicobar Islands
  • Lakshadweep
  • Dadra & Nagar Haveli and Daman & Diu

Earlier, it also included Puducherry, but after it obtained a legislature, the Article applies only in limited situations.

3. Key Points:

  • Regulations made by the President have the same force as Parliamentary laws.
  • They can repeal or amend existing laws in these UTs.
  • This power is exercised when the Legislature is absent or not empowered.

Why Chandigarh Is Not Under Article 240

1. Chandigarh is governed under Article 239, where the President appoints an Administrator.

2. Bringing Chandigarh under Article 240 would:

  • Change its governance structure.
  • Grant the President direct regulatory powers.
  • Allow appointment of an independent Administrator.

Bharat NCAP 2.0 – Revised Draft Released

The Ministry of Road Transport and Highways (MoRTH) has issued a revised draft framework for Bharat NCAP 2.0, expanding the vehicle safety assessment parameters beyond crash tests.


About Bharat NCAP

1. Launch:

  • Introduced in October 2023 to provide consumer-friendly safety ratings for passenger vehicles.
  • The current phase remains valid till 2027.

2. Nature of the Programme:

  • Voluntary-manufacturers can choose to submit vehicles for evaluation.

3. Implementing Agency:

  • Ratings are issued by the Central Institute of Road Transport (CIRT), Pune, the designated testing and certification authority.

4. Testing Protocol:

  • Vehicle assessments follow the procedures outlined in Automotive Industry Standard (AIS)-197.

What’s New in Bharat NCAP 2.0?

Under the revised model, a vehicle’s star rating will be determined across five assessment categories:

  • Crash Protection: Evaluates occupant safety in frontal and side-impact crash scenarios.
  • Vulnerable Road User Protection: Assesses safety measures for pedestrians, cyclists, and other road users.
  • Safe Driving: Examines design features that encourage safer driving behaviour.
  • Accident Avoidance: Focus on advanced driver assistance systems (ADAS) and other technologies that help prevent collisions.
  • Post-Crash Safety: Measures the ability of a vehicle to support safe rescue operations after an accident—e.g., e-call systems, fire risk, ease of extrication.
